Contracts

The City Carolers

The City Carolers LLC conducts business under various local trade names, including Atlanta City Carolers, Greenville City Carolers, Knoxville City Carolers and Asheville City Carolers, etc., for marketing and performance purposes. These trade names are not separate legal entities but are all operated by The City Carolers LLC. Depending on the performance location, the Singer's services may be performed under one or more of these trade names. For the purposes of this Agreement, the term "Contractor" refers solely to The City Carolers LLC, regardless of the trade name under which services are marketed or provided.

Singer-for-Hire Agreement

By checking each box below and signing at the end, you confirm that you have read, understand, and agree to every section of this agreement.

1. Services

The Singer agrees to provide performance services for future events/gigs as requested by the Contractor. The specific details of each gig, including the event name, date, location, duration, on-location contact, and any other pertinent info specific for a successful gig, will be provided by the Contractor to the Singer with sufficient advance notice.


  • Notice Period: The Contractor's Regional Coordinator will provide as much notice as possible before each scheduled event. However, the Singer acknowledges that some events may be scheduled on short notice, and agrees to accommodate these when feasible.


  • Acceptance: The Singer must contact their Regional Coordinator to accept or decline the proposed gig within 24 hours of receiving the offer. If no response is received within that time, the gig may be offered to another singer without notice.


  • If the Singer is unsure of their availability, they must notify their Regional Coordinator within the 24-hour window and specify that they will provide a final answer within a mutually agreed-upon time frame.

2. Compensation & Independent Contractor Status

The Contractor agrees to pay the Singer the following rate for each performance:


  • Base Rate: $75 for the first hour of performance.

  • Additional Time: $25 for each additional half hour after the first hour.

  • Christmas Eve/Christmas Day Rate: A minimum of time and a half or double depending on negotiations with client.

  • Travel Compensation: If the Singer is required to travel beyond the standard service area or incur extended travel time, additional travel compensation of approximately $20 or more may be provided. The final amount shall be subject to negotiation and mutual agreement between the Contractor and the Client.


Pay dates will be approximately 12/15 and 12/31. Singers are considered Independent Contractors. The 1099 Tax form is necessary for Singers earning $600 or above per year.

3. Performance & Rehearsal Expectations

The Singer agrees to:

  

  • Professionalism: Maintain a high standard of professionalism during rehearsals, sound checks, and performances, (includes when you are strolling or ‘on stage’ while in costume.)


  • Preparedness: Come to every rehearsal and performance fully prepared, with all assigned music learned and thoroughly rehearsed in advance. Singers are expected to know 100% of the repertoire and perform it with the highest level of musical excellence, accuracy, and professionalism.


  • Performance Level: Perform to the best of their ability and in line with the musical and performance standards expected by the Contractor and gig lead: using discretion and choosing songs that are appropriate to the event’s audience and situation.


  • Rehearsal Attendance: Attend a minimum of 4 rehearsals to help maintain our high performance standards. As an added incentive, first-year singers who attend all 5 rehearsals will receive a $5 per gig Costume Bonus.


  • Communication & Reliability: Honor all confirmed gig commitments. Once you have accepted a performance, you are expected to fulfill that commitment as scheduled. If you become ill or experience an emergency that may prevent you from performing, contact your Regional Coordinator as soon as possible to discuss your situation, explore rescheduling options, and arrange for a replacement performer if needed. If a replacement cannot be secured, you are expected to make every reasonable effort to fulfill your commitment and perform the gig whenever possible to help ensure we meet our obligations to the client and maintain strong client relationships.


  • Block-Out Dates: Submit block-out dates in Planning Center promptly to facilitate accurate singers scheduling by the Regional Coordinator.


  • Gig Timeliness: Arrive on time if not early for all scheduled gigs. Your gig Call Time will always be 15 minute prior to the gig, but when possible it is best to arrive even earlier than said call time when considering traffic, parking, and getting from your car to the specific meeting location. Consistent late arrivals may result in a reduction of compensation, less bookings or termination of the contract. Stay in contact with your regional coordinator and your quartet lead if any delays are expected.


  • Gig Lead: If you confirm, you agree to take on the Gig Lead responsibilities, which include:

    • Ensuring your quartet (or octet) knows the call time and meeting location at least 12 hours prior to the scheduled gig.

    • Coordinating with the client contact before and during the performance.

    • Helping select songs with your group during the gig.

    • Ensuring the performance runs smoothly and the client is satisfied.

    • Potentially picking up a payment check from the client after the gig.

    • Making final decisions when needed during the gig.

    • Informing your Regional Coordinator of your gig successes, as well as any issues or incidents that may have occurred throughout the duration of the scheduled performance.


4. Costumes & Appearance Standards:

Singers will perform in the agreed-upon Dickensian costume. The Singer is responsible for purchasing and providing their own Dickens-style costume, which must meet the visual and high professional standards of the group. Costume quality is greatly considered when casting a gig, so put your best foot forward!


  • First-Year Costume Bonus: To help offset the cost of purchasing a costume, singers in their first year of performing with the City Carolers will receive a $5 costume bonus per gig if they attend at least all 5 scheduled rehearsals.


  • Costume Rental: f you prefer to rent rather than purchase a costume, most larger cities have local costume rental shops.


    For the Greenville City Carolers (only), we may also have a limited selection of costume pieces available for rent or purchase. Any rented items must be properly cared for and returned in good condition. Singers are financially responsible for any loss or damage resulting from negligence. 5. Confidentiality and Non-Compete

The Singer agrees:


  • Confidentiality: The Singer agrees not to copy, share, distribute, or otherwise provide any proprietary music, arrangements, or other musical materials supplied by the Contractor to any person or organization outside of The City Carolers. This restriction does not apply to public domain works or hymns.


    Unless an arrangement was specifically commissioned or written for the exclusive use of The City Carolers, it may be purchased separately for use outside of the company. The Singer must obtain such arrangements through the appropriate legal purchase channels rather than using copies provided by the Contractor.


  • Non-Compete: The Singer shall not use or disclose any music arrangements, performance methods, procedures, personnel, or other proprietary materials or practices unique to The City Carolers for the purpose of establishing, operating, or contributing to any competing choir, caroling group, or similar organization without the Contractor's prior written consent.


6. Cancellation and Termination

The Singer agrees:


  • Upon formally accepting a gig through Planning Center, the Singer agrees to perform at the scheduled gig and is obligated to fulfill the commitment.


  • If the Singer feels unable to perform due to illness, emergency, or any other circumstances beyond their reasonable control, they must notify their Regional Coordinator immediately and work collaboratively with them to identify an appropriate replacement for the scheduled engagement.


    If a suitable replacement cannot be secured, the Singer is expected to fulfill the performance obligation or may be subject to a reasonable fee or reimbursement for any documented losses, expenses, or damages resulting from the inability to provide coverage.


  • If the Contractor/Client cancels the event within 48 hours for reasons other than emergencies or inclement weather, the Singer will be entitled to $25 of standard deposit. or similar percentage rate if client negotiated lower.


  • If the Singer breaches this Agreement, the Contractor reserves the right to terminate the Agreement and withhold payment.

  1. Media Release Authorization

I authorize The City Carolers to use my image, likeness, and voice from performances and rehearsals for marketing, publicity, social media, website content, promotional materials, and other advertising purposes.

  • I understand that , unless otherwise discussed, no additional compensation will be provided for such use.

  • I understand that this authorization applies to materials captured during my involvement with The City Carolers and may continue after my participation ends.

8. Miscellaneous

  • Governing Law: This Agreement shall be governed by the laws of the state of SC.

  • Agreement: This Agreement along with an understanding of the “Prospective Caroler FAQs” page on our website constitutes the entire agreement between the Parties.

  • Amendments: Any amendments to this Agreement must be made in writing and signed by both Parties.

Final Agreement & Signature

By signing below, I acknowledge that:

  • I have read and understand all sections of this Singer-for-Hire Agreement.

  • I agree to fulfill the expectations and responsibilities outlined above.

  • I understand that by checking the boxes above and providing my electronicsignature, I accept this Agreement, which will remain in effect indefinitely unlessterminated in accordance with its terms. My electronic signature has the samelegal force and effect as a handwritten signature.

  • I understand that this Agreement becomes effective upon execution by the Singer and does not require the Contractor's signature to be enforceable. By performing any Services under this Agreement, the Contractor acknowledges that it has read, understood, and agrees to be bound by the terms and conditions of this Agreement.
